Restrictive Business Practices

Sections 126 and 127 of the Fair Trading Act 2022, prohibit enterprises from engaging in agreements, decisions or concerted practices that are deemed to be restrictive or anti-competitive. The Fair Trading Commission, along with numerous competition agencies worldwide, sets a very high priority on enforcement of the provisions on restrictive business practices. Enterprises operating in Seychelles are strongly advised to avoid intentional breaches of these sections of the Fair Trading Act 2022 and to seek legal or other expert guidance on any aspects of their business that might inadvertently breach the provisions.

The Fair Trading Commission expects enterprises to conduct a thorough review of their practices to ensure compliance with the Fair Trading Act 2022. Any enterprises engaged in restrictive business practices are encouraged to come forward as any enterprise found to be engaged in the aforementioned practices may be fined with a penalty by the Fair Trading Tribunal.
